1. Definitions

For the purpose of this Agreement:

  • “Company” means Climate By Design Ltd.

  • “Client” means any individual, business, or organisation purchasing services, maintenance plans, or warranties from the Company.

  • “Equipment” refers to any air-conditioning, heat pump, ventilation, or associated system installed or serviced by the Company.

  • “Service Package” refers to any residential servicing plan purchased by the Client.

  • “Warranty Package” refers to any extended labour or parts warranty product purchased by the Client.

  • “Agreement” means these Terms & Conditions.


2. General Conditions

2.1 By purchasing any package, the Client accepts and agrees to be bound by this Agreement.
2.2 All services are subject to engineer availability and scheduling.
2.3 The Company may update these Terms & Conditions at any time. Updated versions will be provided upon request.
2.4 Package payments do not include the cost of repairs unless expressly stated. 

3. Service Packages (Residential)

3.1 Included Services

Standard Service Plan – Annual System Health Check.

·       1 Service Visit per year

·       Filter clean

·       Chemical clean of evaporator & condensing unit coil

·       Hot & Cold temperature/visual leak checks

·       System efficiency report

Premium Service Plan – Full deep clean for maximum performance

·       Everything in Standard plan

·       Coil & fan deep clean

·       A drain rinse flush

·       Evaporator coil disinfectant with smell buster

·       Leak check with refrigerant leak detector

·       Priority response

·       25% reduced call out fee

3.2 Excluded Services

The following are not included in any Service Package:

  • Refrigerant top-ups required due to leaks

  • Work required as a result of misuse, accidental damage, or lack of cleanliness

  • Out-of-hours emergency callouts unless specifically included

  • Access equipment such as scaffolding, towers, or lifting equipment

  • Excluding units used for commercial use

3.3 Client Responsibilities

The Client must:

  • Provide safe and unobstructed access to the Equipment

  • Report faults or concerns promptly

  • Keep the surrounding area clean and accessible for engineers

  • Provide a clean water supply if required

3.4 Cancellation

  • The Client may cancel a Service Package within 30 days’ with written notice.

  • No refunds will be issued for unused portions of service periods already paid.

4. Warranty Packages (Extended Labour & Parts)

4.1 Coverage

Warranty Packages may include:

  • Standard Manufacturer Parts Warranty – Valid when the Client maintains annual servicing with the Company.

  • Labour Warranty – Covers labour during the manufacturer’s parts warranty period.

Bronze £inc.

·       Included as Standard with every installation

·       12 Months Labour Warranty

·       60 Months manufacturer’s Warranty

·       Only valid with an annual service or service plan

Silver £1.99 p/month

  • 60 Months Labour Warranty

  • 60 Months manufacturer’s Warranty

·       Only valid with an annual service or service plan

Gold £3.49 p/month

  • 84 Months Labour Warranty

  • 84 Months manufacturer’s Warranty

·       Only valid with an annual service or service plan

4.2 Conditions of Warranty

To remain valid, the warranty requires:

  • Equipment installed by the Company or an approved installer

  • An active Service Package for the full warranty term

  • Annual servicing completed on schedule

  • No unauthorised repairs, alterations, or modifications

4.3 Exclusions

Warranty Packages do not cover:

  • Damage caused by power surges, flooding, pests, or misuse

  • Cosmetic damage such as scratches or discolouration

  • Consumable items (filters, batteries, etc.)

  • Damage caused by third parties (e.g., builders, electricians)

  • Failures caused by poor or insufficient maintenance

4.4 Warranty Claims

  • Any suspected fault must be reported immediately.

  • The Company will diagnose the issue; if the fault is non-warranty related, standard labour charges will apply.

6. Fees & Payment

6.1 All package fees must be paid monthly or annually in advance.
6.2 Overdue payments may result in suspension of services until payment is received.
6.3 Prices may change annually; the Client will be notified at least 30 days in advance.

7. Liability

7.1 The Company will not be liable for:

  • Loss of business, revenue, or profit caused by equipment downtime

  • Damage resulting from events beyond the Company’s control (e.g., storms, fire, flooding, vandalism)

  • Pre-existing faults or defects

7.2 The Company’s total liability is strictly limited to the value of the package purchased by the Client.

8. Termination

Either party may terminate this Agreement with 30 days’ written notice.
The Company may terminate the Agreement immediately if:

  • The Client fails to make payment

  • The Equipment is deemed unsafe

  • Safe working conditions are not provided

  • The Client relocates or vacates the premises

9. Governing Law

This Agreement is governed by the laws of England and Wales.
